Assault (often times referred to as "Battery" in the municipal courts) describes the use of force or violence on another person. This use of force may be found to be criminal or unlawful in nature and a person may be prosecuted for such a violation in the state and municipal courts.

Assault is classified in degrees related to the severity of the violence and/or injuries inflicted. First and second degree assaults occur where there are serious bodily injuries and/or a deadly weapon is used in the assault. First and second degree assaults are considered to be very serious felony “crimes of violence” and a conviction may result in mandatory prison time.

Misdemeanor assault or third degree assault occurs when a person uses force against another but the injury involved can be as little as slight pain. This is the most prevalent type of assault and occurs in all types of situations including but not limited to violence that occurs in an intimate relationship (“domestic violence”). Third degree assault may result in the imposition of a two year county jail sentence.

Municipal courts generally refer to the use of force or violence against the person of another as “Battery.” Because of the limited jurisdiction of municipal courts, the offense is subject to the imposition of one year of jail and/or a fine not to exceed $1000.00.

There are numerous defenses applicable in assault cases including but not limited to self-defense, defense of others, choice of evils, duress, and corporal punishment (i.e. parental discipline). These types of defenses are referred to as “affirmative defenses” and must be brought forth by the defendant at trial.
