The US Supreme Court recently determined that the constitutional right to bear arms is an "individual right" as opposed to a right attached or connected with service in a militia. District of Columbia v. Heller. The ramifications of the Heller opinion will not be known for many years but the ultimate decision made clear the Second Amendment to the United States Constitution protects an individual’s right to own and possess firearms and this same decision limits the ability of the government to deny such ownership and possession. In addition to the federal protection found in the United States Constitution, the Colorado Constitution, art. II § 13, affords citizens an even greater level of protection. People v. Ford, 568 P.2d 26 (Colo. 1977).

Concealed Weapon Permit Victory in Colorado Court of Appeals

On December 24, 2009, the Colorado Court of Appeals reversed the judgment of the Arapahoe District Court upholding Sheriff Robinson’s decision to deny my client a Colorado concealed weapon permit. Sheriff Robinson’s decision violated every notion of due process imaginable including notice and a hearing. This was the first case interpreting the Concealed Weapon Permiting Statute (C.R.S. 18-12-201 et seq) and the Court of Appeals determined the case to be of such importance that the decision was published and is now case law in the State of Colorado. As applied to concealed carry permits, the Colorado General Assembly declared, "the issuance of a concealed handgun permit is based on a person’s constitutional right of self-protection and there is a prevailing state interest in ensuring that no citizen is arbitrarily denied a concealed handgun permit…" C.R.S. §18-12-201(1)(e). In the face of this unequivocal language, the government and local sheriffs continue to infringe upon the right of an individual to own and possess firearms for hunting, sporting, and protection.
