According to Colorado Revised Statute 18-18-405(1)(a), “it is unlawful for any person knowingly to manufacture, dispense, sell, distribute, possess, or to possess with intent to manufacture, dispense, sell, or distribute a controlled substance; or induce, attempt to induce, or conspire with one or more other persons, to manufacture, dispense, sell, distribute, possess, or possess with intent to manufacture, dispense, sell, or distribute a controlled substance; or possess one or more chemicals or supplies or equipment with intent to manufacture a controlled substance.”
The most common drugs prosecuted under Title 18 are cocaine, methamphetamine, heroin, ecstasy, and prescription pharmaceuticals. However, there are dozens of controlled substances listed as illegal controlled substances in Colorado.
A conviction for an “extraordinary risk crime” like drug distribution could possibly lead to a harsher punishment and longer prison term. As an example, possession with intent to distribute methamphetamine, with no aggravating factors, could land you in prison for up to sixteen years for a first offense. Additionally, the sentence for a drug distribution offense can vary based on additional factors, such as the amount of drugs involved.
In addition, Special Offender charges are filed by the prosecuting district attorney for drug distribution charges if certain factors are present, like a prior felony drug conviction, whether the transaction occurred in proximity of a school, or if a firearm was present. A Special Offender charge in Colorado is a Class 2 Felony.
