Habitual Offender

Individuals with prior felony convictions are subject to extremely harsh sentencing enhancement pursuant to Colorado’s habitual sentencing laws.  Habitual sentencing in essence means that an offender’s maximum presumptive prison term will be multiplied by three (3) or four (4) times based on the offender’s prior felony criminal history. 
Three strikes or habitual offender statutes envisioned sentencing violent persons to lengthy prison terms.  However, District Attorney’s, especially in one well known jurisdiction, have utilized habitual sentencing laws in order to obtain lengthy prison sentences for minor felonies, including the possession of a very small amount of illegal drugs.  

Persons charged with Habitual Sentencing Counts have a right to contest the new felony complaint and the person has the right to contest the imposition and validity of the “bitch” counts.
