In essence the crime can be committed by the simple act of using a friend’s credit card number to order pizza delivery.

Misidentification of the person using the device occurs frequently and often arrests are made on very little circumstantial evidence. Following an arrest, or during the scope of an investigation, persons often admit to law enforcement that they used another person’s credit card but for a very good reason. Note – the government doesn’t care if there was a good reason or not – law enforcement simply cares about getting a confession, clearing the case by arrest, and getting the file off of their desk.
