Misdemeanors
Misdemeanor offenses in Colorado are crimes in which the possible punishment includes confinement in the county jail and fines. Probation is granted in these cases in place of an actual jail sentence and the terms of probation may include domestic violence counseling, anger management, and alcohol/drug education and treatment. Misdemeanors are divided into three classes. Class 1 Misdemeanors, such as Assault or Unlawful Sexual Contact, are subject to between 6 months and two years in jail and a fine between $500 and $5000. Class 2 Misdemeanors are subject to 3 to 12 months in jail and/or a fine between $250 and $1000. Class 3 Misdemeanors carry a fifty to $750 fine and or up to 6 months in jail.
Misdemeanor crimes are generally less serious than a felony level offense; however, a conviction may result in the imposition of up to a 2 year jail sentence. As with felony matters, an accused has the right to a jury trial but with misdemeanors the jury is comprised of 6 individuals.
A majority of domestic violence cases – those without serious bodily injury – are prosecuted as misdemeanors in the county court. The ramifications of domestic violence convictions will result in the imposition of domestic violence classes, protection orders, and loss of gun possession and ownership rights.
