The "right to bear arms" is guaranteed by the United States Constitution, Amend. II. The US Supreme Court recently determined that the constitutional right to bear arms is an “individual right” as opposed to a right attached or connected with service in a militia. District of Columbia v. Heller. The ramifications of the Heller opinion will not be known for many years but the ultimate decision made clear the Second Amendment to the United States Constitution protects an individual’s right to own and possess firearms and this same decision limits the ability of the government to deny such ownership and possession.
