"Shoplifting" is a type of theft offense which occurs in a retail establishment. Although shoplifting may involve very little monetary loss for a store, these types of offenses are prosecuted vigorously by the major retailers and because shoplifting falls within the umbrella of all theft offenses it is a crime of moral turpitude with serious penalties.

Theft offense require the government to prove beyond a reasonable doubt that a person knowingly obtained or exercised control over anything of value without authorization and with the intent to permanently deprive the owner of the thing of value. In shoplifting cases, the government stacked the deck in its favor by putting language to the effect that "the concealment of an item on or about a person" (i.e. putting an unpaid item in a person’s pocket while in a store) is presumptive evidence the person intended to take the item. This can be a very unfair presumption for persons whose attention is diverted to taking care of children and mistakenly places an item in their purse or pocket.
